Participating lenders require that those seeking loans complete the entire online application in order to be considered for a pay day loan. Consumer wishing to participate in getting faxless payday loans will be required to fill out the application(s) form and may need to provide specific information before their loan can be processed. Information collected in the quick pay day loan applications include full name, address, phone number, and employment information. Applicants will also need to provide their social security number, e-mail address, and banking account information. No Fax Payday collects this information for the purpose of providing quick personal loans. The site adheres to a privacy policy containing a different set of conditions and terms that the applicant will need to agree to. These terms and conditions have been included in this policy below.
Upon submitting the personal loan application to No Fax Payday, the company will then provide the borrower’s application information to all lenders that are participating in the No Fax Payday program. Upon submitting the loan application to No Fax Payday, you agree and understand that the information will be provided to lenders that are participating in the No Fax Payday program. In order for our participating lenders to meet your loan needs you will be agreeing to allow your application information to be submitted to each of our participating lenders. Information provided to participating lenders will include, but not be limited to information provided on the application, including your telephone and address information. By doing this, they may provide you with additional offers that could be of interest to you.
Once your application information is given to participating lenders, they will be reviewing your information to see if it meets the minimum qualifications for obtaining the loan you are applying for. In doing this, the lender may in turn verify some of your information, such as performing a credit check, verifying your employment, social security number, and comparing your information with a national database, such as DP Bureau. The national databases track consumer transactions that are made with lending entities. All consumers will be agreeing to this process by submitting their application and agree that the lending institutions will have permission to research, verify and review all personal information provided, as needed.
Upon submitting your application you will be directed to a lender Web page if your loan qualifies and meets the requirements set forth by the lenders. Once you are redirected to their site you will be adhering to their terms and conditions, along with their privacy policies and terms of use, and understand at that point your application has nothing further to do with No Fax Payday. Once your browser is re-directed to a lender’s site your involvement with No Fax Payday will cease.
By agreeing to the terms and conditions set forth in this agreement you understand that No Fax Payday is not a lender. Nor does No Fax Payday make any decisions regarding one’s credit or loans. Furthermore, they do not guarantee that you will get any loans with their participating lenders. The position of No Fax Payday is that of a facilitator that merely brings consumers needing pay day loans together with participating lenders that provide them. No Fax Payday places no guarantees on any of the products, prices, rates, terms, or fees that you may agree to with the participating lender and will not be held responsible for such terms.
By agreeing to these terms you understand that No Fax Payday does not make any recommendation or endorsement of any participating lenders, nor are we an agent. No Fax Payday does not get involved in the determination process of your application. The information is between the consumer and the participating lenders, who will be making all determinations regarding personal loans. The lender you make an agreement with will be responsible for all services you agree to and you agree that No Fax Payday has no responsibility for the loan. All damages or costs that arise from the loan matching program will need to be taken up with the lender, as No Fax Payday will not be held responsible. You also realize that whether or not you qualify for a pay check loan, your information will be kept by the participating lenders.
No Fax Payday reserves the sole right to make any changes in their information, functions, features, and loan matching service without making prior notices. You may be denied access or services for any violation; without prior notification and No Fax Payday retains the ability to terminate your service if you have violated any of the terms set forth in this agreement, or has acted in an inappropriate manner with No Fax Payday or any of its participating lenders. No Fax Payday will not be held responsible for any delays or errors that take place by using our quick loan process, which includes any problems that may arise from technical origins.
Disclaimers and Limitations

Resolving Disputes
If there are any controversies that arise in regard to this site or the No Fax Payday service, you agree that all disputes will be resolved and settled in full through binding arbitration. Further you agree that all rules regarding the arbitration will be in adherence to those set forth by the American Arbitration Association at the time of the dispute. All arbitrations with NoFax Payday will be held in San Diego, California and any judgments may be entered into a San Diego court. You also agree that the arbitrator does not have the ability or power to make award decisions regarding any disputes you may have with NoFax Payday. Further, the arbitrator does not have the ability to multiply any awards for damages and waives any claims regarding this issue if they arise. You agree to use an arbitrator regardless of the claim or nature of the dispute that you are contesting.
NoFax Payday reminds you that by agreeing to the terms and conditions set forth that you are agreeing to binding arbitration and waive all rights to participate in any type of class action cases. Arbitrators will be the determining entity, rather than any judges or juries, which you have waived your rights to. By submitting your application with NoFax Payday you have consented to all the restrictions set forth.
If for any reason the arbitration guideline set forth is not enforceable, you agree that any type of suit will be held exclusive in the federal and state courts with the state of California and the county of San Diego. You also agree that any such claims must be filed within one year after the action or it will be barred from there on.
Additional Conditions
The terms and conditions set forth outline the agreement that you are entering into with NoFax Payday. The terms and conditions are governed by the State of California. If the conditions in this agreement are deemed unlawful or unenforceable by law, then the provisions set forth will be superseded by enforceable conditions that closely relate to the original intention set forth in these provisions. If NoFax Payday fails to enforce any portion of this agreement or amend the terms, it is not to be viewed as a waiver of their rights. Terms that are updated or changed are automatically in effect once posted to the company site.
